GENERAL TERMS AND CONDITIONS OF STEVIA TRADE LTD FOR PURCHASE AND SALE THROUGH WWW.STEVIALUX.EU
These general terms and conditions govern the order, manner and conditions of purchase and sale through the online store www.stevialux.eu, owned by STEVIA TRADE Ltd., hereinafter referred to as “Stevia Lux”. These general terms and conditions represent a contract of sale between STEVIA TRADE Ltd. and the Client. STEVIA TRADE Ltd. provides the Client with the opportunity to purchase the goods offered through Stevia Lux by making a request and paying the respective selling price, subject to compliance and compliance by the Client with these General Terms and Conditions. The customer may make valid orders for the purchase of goods and services offered through Stevia Lux only after agreeing to these General Terms and Conditions, which he considers to be bound by the provisions of the General Terms and Conditions and undertakes to comply with them.
I. GENERAL PROVISIONS
For the purposes of these General Terms and Conditions, the following terms are used with the following meanings:
Stevia Lux is a registered trademark of STEVIA TRADE LTD
STEVIA TRADE Ltd. is a trade company registered in the Commercial Register at the Registry Agency with UIC: 202374205, VAT ID: BG202374205, with registered office and address of management BULGARIA, Sofia district, Kokalyane village, 32 VASIL LEVSKI str. and online services through the Stevia Lux brand (http://www.stevialux.eu).
The object of sale are the goods and services offered on the site, and they are described and classified into separate categories according to the concept of the site. Typographical errors, differences in the color visualization of the user’s computer configuration, as well as periodic changes in the design and arrangement of products are possible on the site.
“Customer” means a natural or legal person who has registered a customer account with Stevia Lux and has agreed to these General Terms and Conditions. By submitting an order / request, the Client-individual declares and confirms that he has reached 18 (eighteen) years of age. Stevia Lux reserves the right to refuse an order in case of doubt for the Client’s 18 years of age.
“Client profile” means information about the Client (name, surname / trade company, address (city, district), postal code, telephone, e-mail address, UIC / Identification number, VAT ID, Mall, etc.), provided by the latter when completing the registration form and kept by Stevia Lux for the purposes specified in these general terms and conditions.
“Sales price” means the price per unit or for a certain quantity of goods, including VAT, excluding the cost of delivery of the goods, except when explicitly mentioned.
Stevia Lux reserves the right to correct incorrect parameters of the products, as well as to change the prices without being obliged to notify its Customers in advance.
II. PURCHASE THROUGH WWW.STEVIALUX.EU
All prices listed on the site are in Bulgarian levs including VAT and do not include delivery price.
The application for the purchase of a product is considered to be the consent of the consumer regarding its type, quality and price.
Stevia Lux does not guarantee the availability of the ordered items. In case of impossibility to fulfill its obligations due to the fact that it does not have the goods ordered for purchase available, Stevia Lux, within the day on which the order is placed, notifies the Customer (by phone or by sending an e-mail). mail specified by the Client in the registration form), for the exhaustion of the goods and for the possibility to change the order at will. In case a payment has been made and the Client does not wish to change his order, the amount paid for the ordered item (s) will be refunded within 15 working days after receiving feedback from the Client.
III. Purchase orders / requests
In order to receive the right to make valid orders / requests for the purchase of goods offered through Stevia Lux, the Customer must express / declare his consent to these General Terms and Conditions by providing Stevia Lux with the following information:
FOR INDIVIDUALS: name, surname, address, telephone, e-mail (e-mail address);
FOR LEGAL ENTITIES: trade company, telephone, e-mail address, company registration address, UIC identification number, VAT ID, MOL.
The Client guarantees that the data he provides when filling in the registration form are true, complete and accurate and will update them in a timely manner if the latter changes. In the event that the Client provides incorrect and / or outdated data, Stevia Lux has the right to stop immediately and without notice the maintenance of the Client’s registration and access to his client profile. The customer is fully responsible for the protection of his password, as well as for all actions performed by him or by a third party who has been granted access to his Stevia Lux account.
Consent to the General Terms and Conditions – by ticking the box “I agree with the General Terms and Conditions for purchase and sale through Stevia Lux” upon registration, the Client makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, declaring that he is aware of General conditions, accepts them and undertakes to comply with them.
Each purchase request from the Client through Stevia Lux, based on these General Terms and Conditions, is submitted and executed in execution of the contract of sale between the parties.
A customer who is a consumer within the meaning of the Consumer Protection Act has the right, without paying compensation or penalty and without stating a reason, to withdraw from the contract for the purchase of goods through the e-shop Stevia Lux by terminating his registration by submitting to a written application in the short contact form or to the e-mail of STEVIA TRADE LTD.
IV. Procedure for placing an order / purchase request
The client has the opportunity to view and / after registration / to order the goods announced in the catalog.
Orders over BGN 23 with VAT without delivery are accepted.
In case of incomplete, incorrect or wrong address and / or telephone number when submitting the order / request, it is considered invalid and Stevia Lux is not obliged to fulfill it.
The client has the right to be informed about the status of his order by e-mail: stevialux@abv.bg, or by phone 0885 524 655.
V. Acceptance of the order / request
Acceptance of the order is confirmed / certified by Stevia Lux within 24 hours after checking the availability of the requested items by sending a message to the e-mail address of the Client, with the following content: order number; information about the ordered goods; total amount of the order; value of transport costs; supplier information.
Orders are accepted at least 48 hours in advance. It is also possible to fulfill the order earlier, with an explicit additional clarification between the parties on the telephone number 0885 524 655, only if possible and the availability of products.
VI. Prices and methods of payment
For the convenience of legal entities, all prices of goods in Stevia Lux are in Bulgarian levs and are shown with VAT included. The prices are for a single piece (packaging), except in cases when the offered goods are sold by weight (in this case the indicated price is for the announced weight) and do not include delivery costs, unless explicitly mentioned.
The price and delivery costs can be paid in one of the following ways:
a) in cash by the Client or by a third party on behalf of the Client, at the time of delivery;
b) by bank transfer, by transfer to the bank account of STEVIA TRADE Ltd;
c) by credit or debit card.
d) in case of delivery of goods, made by individual order of the Client, it is necessary to make an advance payment in the amount of 50% of the value of the order, unless otherwise agreed. By choosing the method of payment provided for in item VI, points b), c) or d) of the General Terms, the Customer – consumer under the Consumer Protection Act, agrees to make an advance payment for goods within the meaning of Art. 53, para 1 of the law.
VII. Delivery
The delivery price is not included in the price of the products and is paid separately as follows:
Within the city of Sofia, its value is calculated depending on the region in which the delivery is to be made.
For deliveries on the territory of the Republic of Bulgaria, the price is according to the price list of the courier company performing the delivery.
This type of delivery applies to all goods other than perishable goods
Deliveries are made from 10:00 to 17:00
Deliveries for the same day are made, if possible, only from the available products with additional specification on the telephone number 0885 524 655.
Corporate customers with special conditions in the contract may have free delivery under the conditions described in the specific contract.
The delivery of short-lived products is currently carried out only within the city of Sofia.
Stevia Lux is not responsible for delays in delivery, in cases where the delay is due to the fault of the courier company.
Stevia Lux does not commit to an exact delivery time.
VIII. Delivery of the goods
The goods are handed over to the Client or to a third party, who accepts and confirms the receipt of the same on behalf of the Client by signing the documents accompanying the goods. In case the Customer is not found within the delivery period at the address specified by him or access and conditions for delivery of the goods are not provided within this period, Stevia Lux is released from its obligation to deliver the goods ordered for purchase.
The customer can confirm his desire to receive the goods after the expiration of the delivery period in which he was not found at the address, bearing all costs of re-delivery. In this case, a new delivery period starts to run from the moment of the confirmation under the previous sentence. In case of refusal to receive the goods, except for the cases described below, the refusal is considered unfounded and the Client owes payment for the payment.
The customer has the right to refuse to receive the goods ordered by him when:
-the delivered goods clearly do not correspond to those ordered by him and this can be established by its ordinary inspection;
-the goods or their packaging were damaged during transportation.
IMPORTANT: The responsibility for checking for non-conformities of a general nature (type, quantity, visible defects) of the shipment at the time of delivery is entirely at the expense of the Customer. By signing the Handover Protocol or the relevant documentation of the courier company, the Customer certifies that he has received the goods in the pre-ordered form, quantity and term.
Complaints regarding the type and quantity of the received goods are accepted before the signing of the Handover Protocol by the Client or the person authorized to receive the shipment. In case of claims submitted at the time of delivery by the Customer, the same requires from the supplier of Stevia Lux “Complaint Protocol”, and in the case of delivery by courier – the so-called. “Bilateral protocol for damaged shipment”, which is filled in at the time of delivery of the goods.
After receiving the goods, the Customer has the right within 14 days to request its return in the presence of a significant defect, which could not be established during a simple inspection of the same. In this case, the Customer may request that the goods delivered to him be replaced or that the amount paid by him be refunded. The return statement is announced by sending a written request through the short contact form with STEVIA TRADE Ltd. on the website www.stevialux.eu or by e-mail, indicating the relevant choice of the Client. The customer is obliged to return the goods intact, fully completed with all accompanying documents, including a certificate of quality, without any external or internal defects, in the original and supplied by the manufacturer packaging, including, but not limited to from the manufacturer polystyrene or other protective elements
Return of goods does not apply in the following cases:
-upon delivery of goods made in accordance with the requirements of the consumer or by his individual order; in case of delivery of goods which due to their nature cannot be returned or are subject to rapid deterioration, or there is a danger of deterioration of their quality characteristics;
-in case of delivery of goods, damaged and / or changed after the moment of their receipt; when the individual packaging of the goods is damaged or missing.
In case the Customer withdraws from the contract within the deadline, he should send a statement of withdrawal to Stevia Lux and return the goods intact, fully completed with all accompanying documents, including a document Certificate of Quality, without any external or internal defects, in the original and placed by the manufacturer packaging, including, but not limited to polystyrene or other protective elements installed by the manufacturer, protective film markings, etc., and delivery costs are borne by the Customer . The statement of refusal should be sent to the e-mail of STEVIA TRADE Ltd .: stevialux@abv.bg or through the simplified contact form in the Orders section of the website www.stevialux.eu. The Customer is obliged to store the goods received from him, to ensure the preservation of its quality and safety. Stevia Lux is obliged to refund to the Customer in full the amounts paid by him no later than 14 (fourteen) days from the date of which the Customer has returned the goods in the form described above.
STEVIA TRADE Ltd. guarantees the inviolability of the information containing personal data provided by the Clients. Disclosure is possible only in cases where the information is requested by state bodies or officials authorized by law to request and collect information containing personal data and in compliance with the statutory order. By accepting these General Terms and Conditions, the Client agrees to the processing of his personal data for the purposes of direct marketing. The customer has the right to object to the processing of his personal data for the purposes of direct marketing by sending a written notice to the above contact address. All goods have an individual expiration date.
STEVIA TRADE Ltd. reserves the right to change these general terms and conditions at any time by promptly publishing these changes on its website http://www.stevialux.eu, together with a notice of the changes. In case of changes in the present general conditions, the Client may declare that he rejects the changes by sending a statement for the rejection of the changes to the specified e-mail stevialux@abv.bg. Upon receipt of the explicit statement of rejection, it is considered that the registration of the Client and the commercial relations between him and STEVIA TRADE Ltd. are terminated.
The changes in the General Terms and Conditions do not affect the relations between the Client and STEVIA TRADE OOD, which arose in connection with a valid application for purchase of goods submitted before the changes.
The provisions of the current legislation of the Republic of Bulgaria shall apply to the issues not settled by these General Terms and Conditions.
